the primary purpose of the Microsoft-IBM "lobby" is to take tight control over all kinds of individual software developments. Especially, this will be reflected in Microsoft's next Windows operating system "Longhorn".In my view, the open-source concept will survive and reshape the entire software industry, but it will take time...Below you can find further comments I discovered on the web-site of www.ffii.org.

1.Experience and economic studies strongly suggest that patents on computer-implemented rules of organisation and calculation (programs for computers), as have been granted by the European Patent Office (EPO) in contradiction to the letter and spirit of the EPC, are not conducive to innovation in the area of software. A recent study (http://www.researchoninnovation.org/swpat.pdf) shows that the same patents have substituted innovation and thus led to a reduction in R&D investment and productivity even those companies that patented most. Reconfirming the invalidity of these patents would reestablish legal security and confidence in investing in software development.
 
2.Unification of caselaw in itself is not a guarantee of improvement of the situation of European industry. This directive should not use a pretext of "harmonisation" for changing the rules of Art 52 EPC, which are already in force in all countries. Also, as explained above, the term "computer-implemented invention" implies that programs for computer are patentable inventions and thereby calls for violation of Art 52 EPC.
 
3.At the international level, Europe is ahead in the area of open, alternative development and licensing approaches to computer programs, e.g. open source projects under the "GNU General Public License". Particularly in the light of increasing requirements for stability, interoperability and IT security of computer programs, open source computer programs developed on a common, ongoing and transparent basis are gaining in importance.
