It can be disguised to look like part of the data stream. With a
little more effort (I hesitate to say what) it would be virtually
impossible.

No - especially if integrated with the data stream.
You must trust Bill COMPLETELY on this issue. He must say "no" and
enforce it rigorously within the company, even though it would be VERY
easy for a rogue programmer to slip it in. You will have to use your
judgement as to his ability to control the development of quality
software.
This assumes he is not in on the deal. It is sooooo easy to do, and
virtually undetectable. It is a GREAT temptation. Irresistible? You
decide.
Read your agreement CAREFULLY. If there is anything suggesting you are
agreeing to give up control, be very careful. Microsoft XP forces you
to agree that M$ can do whatever it wants to with YOUR computer. You
should think through the implications what you are agreeing to.
