Absolutely correct!  False advertising is NOW illegal, no new laws
needed.  The problem is that most ads for systems have the perfectly
legal disclaimer "Past performance etc. etc."

Basically these disclaimers say, "This backtested, optimized,
curve-fitted system produced these fantastic returns, but it probably
won't work for you. However, there is a very slight chance that you may
get rich without working hard, so here's how to order."  

If system vendors were forced to use the above wording, I don't think
they would sell any fewer systems.

There is simply no way to protect people from their own wishful
thinking.
