I don't have LFG's agreements in hand so I don't know specifics about LFG's
agreement. I did email the most onerous terms of JC's agreement to an LFG branch
manager to inquire if they had similar terms and he confirmed they do. Also, I'm
an educated consumer, not a lawyer, so my impressions may be wrong however the
language is pretty strong and it's difficult to figure out where the disclaimer
stops. My cut is that everything is on a best efforts basis when everything is
working and that JC bears no responsibility for the security of its system. I'm
including below the "Terms of Use" and "ETC Rider" to which one must agree each
time one enters the JC ETC. Perhaps this will stimulate some specific discussion
re the terms and conditions of online trading.
ETC Terms of Use:

ETC Rider to Customer Agreement
By accessing and using "ETC" you agree as follows:
Reference is made to that certain Commodity Customer Agreement (the "Customer
Agreement") between Jack Carl Futures, a division of E. D. & F. Man
International Inc. ("Jack Carl"), and the Customer. This Rider is entered
between Jack Carl and the Customer to set forth the terms and conditions
regarding Customer’s use of the ETC (sm) electronic order entry system (the
"System"), and is hereby expressly incorporated into such Customer Agreement and
made a part thereof. All other terms contained in the Customer Agreement shall
remain in full force and effect.
1. Customer expressly agrees that Jack Carl's obligations to execute trades as
set forth below is on a best efforts basis only, and any information provided is
believed to be accurate, timely and reliable, but is not guaranteed. Jack Carl
shall have no liability to Customer for any direct, indirect or consequential
damages resulting from any delays or System failure, including but not limited
to breakdown of software or hardware, communication failures whether line or
other telephonic problems, unauthorized use of Customer's access number or
Account number or unauthorized access to Customer's Account information, loss of
use of the System, or any errors within the System. Customer is responsible for
all orders placed through the System using Customer's access number and Account
number, and any such orders received by Jack Carl are deemed to have been placed
by the Customer in the form received. Jack Carl reserves the right in its sole
discretion to refuse to execute any order received through the System or to
restrict or terminate Customer's access to the System without notice.
2. Customer agrees to notify Jack Carl immediately upon Customer's becoming
aware of any theft, loss of confidentiality or unauthorized use of Customer's
access number or Account number, or of any errors or incorrect information
contained in Customer’s Account.
3. Customer agrees to indemnify and hold Jack Carl harmless from any and all
claims, losses, liability, costs and expenses, including but not limited to
attorney’s fees, arising from any breach of the terms of this Rider by Customer.
4. By pressing the Agree button below, Customer represents that he has read,
