Hi Michael,
You have to check with the NFA.
As for the performance, if it's actual, you should
put the ususal disclaimers: "Past performance is not.... future
results".
Where it's ia little bit more tricky is that most
CTA that do well are also CPO and it's not allowed to advertize to the general
public for a pool (they are restricted to qualified investors). That's why you
see advertising mostly form CTA that sell systems, newsletter etc but don't
really manage money
