CSI claim,
http://www.csidata.com/techjournal/csinews/199906/page01.htm
"No other firm has the legal right to market a
futures-related product called a "Perpetual Contract," or "perpetual
data", or "perpetual futures contract," or use the term "perpetual"
with respect to data products in the futures industry."
That doesn't sound legally correct,
"Perpetual Contract" is the only registered service mark,
I don't see how they can stop the use of the other terms without
registering them, they say you can't use the word Perpetual
with respect to data products in the futures industry, why doesn't
this also apply to the word Contract as well.

MJ> Reviewing Market Opportunities with Perpetual Contract Data
MJ> The year 2000 will mark the 30th anniversary of CSI's most
MJ> enduring and successful product, Perpetual Contract data.
MJ> Even today, nearly three decades after its development for
MJ> professional market analysis, it is still a controversial
MJ> tool in the trader's arsenal. We have recently increased the
MJ> flexibility of Perpetual Contract data formulation through
MJ> the Unfair AdvantageŽ platform, which seems to have further
MJ> fueled the debate about the pros and cons of blending away
MJ> the gap between old and new contracts. Here's why I love
MJ> Perpetual Contract data - the tool that some traders love
MJ> to hate.
MJ> What's in a name?
MJ> The term "Perpetual Contract" is a registered service mark
MJ> of CSI, so it is protected from use by other firms by
MJ> international law. The term derives its distinctiveness,
MJ> in part, from its oxymoronic use of the word "perpetual,"
MJ> meaning unending, in conjunction with "contract," referring
MJ> to the time-sensitive and finite arrangement between buyers
MJ> and sellers. No other firm has the legal right to market a
MJ> futures-related product called a "Perpetual Contract," or
MJ> "perpetual data", or "perpetual futures contract," or use
MJ> the term "perpetual" with respect to data products in the
MJ> futures industry, etc. because of CSI's development of the
MJ> mark and the concept behind it.
MJ> What is it?
MJ> Perpetual Contract data represents a time-weighted average
MJ> of the prices of the two active contracts whose expiration
MJ> dates lie earlier and later than a fixed number of days ahead
MJ> of the current date. This computed contract provides an accurate
MJ> view of the market's characteristic price-pattern waveform over
MJ> time. ... ... ... ...
