If an ISP believes that it is commercially beneficial to them to
block certain traffic, it is their right to do so.  If you as a
customer do not like it, you are always free to find another ISP.

The free market is criminal?

Well retain this: email doesn't enjoy the same legal protections as
postal mail.  Perhaps it should, but it doesn't, not anywhere in the
world.

And also this: It is NOT criminal to protect ones own property.  As
a customer of an ISP, you are using their property.  Their servers,
their rules.  You have no legal "right" to email transmitted through
the private property of others.

Here's a far better analogy:

If you live in a neighborhood infested by crack-dealing street
gangs, don't be disappointed when the pizza delveryman refuses to
deliver to your area.  Likewise, if you choose bed down with an ISP
who makes a business of supporting spammers, don't be disappointed
when another ISP refuses to accept your traffic.

In any case, I think this is the wrong forum for this debate.  Try
posting your views to news.admin.net-abuse.email.  You'll get an
earful (screenful?), consisting of both angry crap and well-reasoned
arguments far better than I could do here.
