With no prior warning, verbally or in writing has decided not to inspect the machine for maintenance, even though IBM had previously signed a maintenance contract with FTC which contains the SN#17257, as indicated by Jeff Sherrow in more than one conversation with me in February of this year. Qwinstar has continued their effort to work with IBM on this inspection since the position they have taken is without president and Qwinstar believes IBM cannot defend it. I repeat Jim, IBM is the party that has placed us at this point, not FTC or CPG.

I have reviewed all the correspondence and it indicates that the real heart of the matter is you wish to move this acceptance into CPG hands completely so that there is no question that if a satisfactory settlement is not reached with IBM, by Qwinstar, FTC already has their asset secure.
