This information comes from John Teeling; the F.B.I. special agent
who is in charge of the criminal investigation. Upon completion of
his investigation; agent Teeling will present documentation to the
federal prosecuting attorney for an indictment. He would also like
to include a 'victim input statement' file; replete with letters from
individual account holders. This file could prove important should
the trial move to the sentencing phase.
He pointed out that more input statements are presented and heard
in court on behalf of defendents as opposed to victims. Indeed,
judges spend more time hearing input from attornies defending
criminals than they do hearing from crime victims. I think we all are
aware that their lawyers will make pleas to the judge as to why
the defendents are victims in order to achieve more leniency
in sentencing. It could be anything from childhood abuse, drug
abuse, alcholism, being overweight, or the idea that their mother's
didn't hold them long enough when they were infants.
Here, from another source, are some semi-related facts to keep in
mind. Consider the bizarre defense strategy where a lawyer invoked
what is now known as the 'twinky defense'. His attorney argued that
the defendent subsisted entirely on junk food and that is what caused
him to commit the crime. I don't recall the exact offense, but it was
a serious felony in the league of rape, murder, etc. He was found
not guilty.
More germane to our issue is that an embezzler at a financial institution in
Massachusetts received only a 51 month sentence. Also, the average
convicted criminal spends about 35-40% of his sentence
behind bars before being released on either probation or parole.
Personally, I would like to see the individuals who are indicted to
be prosecuted to the full extent of the law. I have no empathy for
someone who lives in a 10,000 square foot house--or owns a 104
foot yacht--then concocts ways to steal money from hardworking
citizens who have lived, worked and played by the rules.
In your letter, simply let agent Teeling know how you feel and how
upset you are about what has happened as a result of your money
being embezzled at Intrust.

voice may be heard by expressing your comments, thoughts and
