I'm aware that news media outside the US are prone to lay blame for many
US ills on the US legal system. While the tort system is driving some
judgements beyond reason, the economic impact is far less than a few
headline settlements would lead one to believe and the reductions on
appeal get far less press. Also, there should be no question that the
potential for legal scrutiny leads to benefits as well as harm -
decreased care and remedial costs result from better products and
services. The fact is that unfettered free enterprise does not always
work well or fairly and this may very well be the case in the drug
industry.
