Shorting against the box no longer exists except for separate types of
accounts. A short against a long position is now considered a
"constructive sale" as of the 5/97 tax revision. There is no rule that
prohibits you from holding the position, but thhe sell short triggers a
taxable event against the long. Ask your tax pro..the change was in the
May revision.
