I've seen many many people attempt to claim status who were offfloor. I
have seen possibly three dozen or so attempts and to the best of my
knowledge only one person has ever survived the process. That is like
one of 30+ attempts. granted I don't know the exact details of
everycase..but the impression I draw is that if an off floor person
tries it...it appears to almost always trigger an audit.
This complicates the matter because because it opens the whole return to
examination and any past capital gains treatment to examination. Given
I work for an exchange one could make the argument that the cross
section I see is skewed to the negative side..I'm not certain ..
