Good point, but the SEC only has jurisdiction on securities, not of futures.
However, if the CFTC, who does have jurisdiction through the NFA, was
serious they could put an end to it all simply by barring the publication of
any historic test results. The only results allowed to be published would
be from actual trading. But then who would be there to take the other end
of your trades?
